Educational Development Software (EDS)
understands that information about your students may be considered confidential
by the Family and Educational Rights and Privacy Act of 1974 (20 U.S. C. 1232g)
(FERPA) unless proper consent is given by your students or their parents/legal
guardians. While in possession of any data or information relating to students,
Educational Development Software (EDS) shall not permit disclosure to any third
party without the prior written consent of the parent or by the student who is
18 years of age or older.
Under FERPA, student 18 years of age
and older have the right to:
· Inspect and review their incident
records;
· Request an amendment to records if they
believe they are inaccurate or misleading;
· Request a hearing if the amendment request
is not resolved to their satisfaction;
· Consent to disclosure of personally
identifiable information from their records, except to the extent that FERPA
authorizes disclosure without their consent;
· File a complaint with the U.S.
Department of Education Family Policy Compliance Office if they believe their
rights under FERPA have been violated.
HIBster practices commercially
reasonable standards to ensure no unauthorized person gains access to student
information considered confidential under FERPA. HIBster also implements
reasonable efforts, such as session-ending after inactivity, to ensure that we
do not unintentionally disclose student information that may be considered
confidential under FERPA to anyone other than personnel within your school
district or other individuals that have been authorized by your school district
to access such information using our system, persons or organizations providing
the students with aid, authorized representatives of federal or state governments
for the audit and evaluation of federal and state supported programs or other
persons required by law.
